Child Custody

Picture
While many couples would prefer to simply end their relationship cleanly, matters can become very complicated if children are involved. If the parents are not able to come to an agreement, the court will have to establish a custody arrangement. Judges consider only the best interests of the child, not the hopes or feelings of the parents. Only a child custody lawyer can adequately assess your case and determine what evidence to present to the court. Ultimately, the court will use that evidence to choose between the many different types of custody arrangements, including:

  • Legal Custody - This is the right to make major decisions about the child's life. Courts typically order the parents to share legal custody.
  • Physical Custody - The parent that has physical custody has the right to control the everyday details of the child's upbringing, including resolving any disciplinary issues.
  • Primary Custody and Visitation - This is one of the most common arrangements. The child spends a majority of school nights with one parent, while the other parent has custody on some weekends and holidays.
  • Shared Custody - If the parents provide equally wholesome environments, the court may order the child to spend the same amount of time in the two homes.
  • Sole Physical Custody - If the judge believes that one parent is a threat to the child's safety, the other parent may receive sole custody.
